Big changes are hitting aboveground storage tanks (ASTs) in North Dakota. The Department of Environmental Quality (DEQ) has adopted N.D. Admin. Code Chapter 33.1-13-01, effective October 1, 2025, under House Bill 1058 (2025). If you own or operate tanks holding gasoline, diesel, kerosene, or heating oil, compliance starts now—with key deadlines in early 2026.

5 Must-Know Requirements
- Register Every Tank – Annual PTRCF registration is mandatory. Fees: $150 base + risk multipliers (up to $300/tank). Register before any spill to qualify for up to $1M in cleanup coverage. Register Now

- Existing Tanks – Within 180 days: Implement one leak-detection method (SIR, auto-gauging, or manual for ≤2,000-gal tanks). Underground piping needs initial tightness test + solenoid valves by Jan 1, 2030. Full Text (DEQ Notice)

- 24-Hour Spill Reporting – Any suspected release (>25 gal, sheen, health threat) = call DEQ immediately. Spill Report Form
